LEGAL / NO FOWL PLAY

Privacy
Policy.

What this website may collect, why it needs it, and who gets to see it. In plain English. The chickens demanded transparency.

Effective date:

01 / WHO IS RESPONSIBLE?

Controller and contact

The controller for the processing described here is Dominik Jeleśniański, operating a business at Sól 234, 34-370 Sól, Poland, tax identification number (NIP): 5532567721.

Privacy questions and requests:
jelongames@gmail.com

This policy covers chickensmustdie.com, its public demo, and information I receive when you contact me or request product support. It does not replace the privacy notices of itch.io, Discord or other independent services you choose to use.

02 / WHAT ENTERS THE COOP?

Data, purposes, legal bases, and retention

Website delivery and technical logs

Your browser and the hosting infrastructure process connection information to serve this website: an IP address, request time, requested resource, response status, browser information, referrer if supplied, and technical or security events.

The purpose is to deliver and protect the service, diagnose faults and prevent abuse. The legal basis is my legitimate interest in operating a working, secure website (Article 6(1)(f) GDPR). Routine technical logs, if created, are retained for no more than two months from collection. A specific incident record may be kept longer if needed to investigate that incident or establish or defend a claim, until the matter and any applicable claim limitation period end. This does not create a general player history.

Public multiplayer demo, nicknames and chat

The game server processes your connection address, temporary session or player identifiers, chosen nickname, current game state and any chat messages you send. This information is used to connect players, synchronise the game and deliver in-game communication. Nicknames and chat messages are shared with other players in the game; relevant game state is transmitted to connected clients.

The legal basis is my legitimate interest in providing the multiplayer functions you request and maintaining a safe, functioning service (Article 6(1)(f) GDPR). The demo does not persist nicknames, chat transcripts or player statistics in a player database. Live state is held temporarily while needed for the session or room and is discarded when no longer needed. Connection or security logs, if generated, follow the two-month limit above.

Sending chat messages is voluntary. Do not publish sensitive or identifying information. Other players can see or copy what you send; I cannot remove copies they make on their own devices. Rules and reporting details are in the Demo Terms.

Messages, support and reports

If you email me or contact me through Discord, I process the details you provide, such as an email address or Discord identifier, your message, attachments and any order reference needed for support. Ordinary enquiries are handled on the basis of my legitimate interest in replying and dealing with reports (Article 6(1)(f) GDPR). Purchase enquiries and contractual support are handled to take requested pre-contract steps or perform the contract (Article 6(1)(b) GDPR).

Ordinary correspondence is deleted within two months after the matter is resolved. Information needed for an outstanding support request, complaint, legal obligation or a specific claim is retained until that purpose is completed and the applicable legal retention or limitation period ends. Access on my side is limited to me, apart from providers involved in transmitting or hosting the communication.

Source-code purchases through itch.io

Source-code sales, payment collection and ZIP delivery take place on itch.io, using its “Collected by itch.io & paid later” payment mode. itch.io is a separate controller for its checkout, accounts and download services. See its Privacy Policy and Terms of Service. I do not receive or store full payment-card details.

Where itch.io makes information available to me, or you send proof of purchase, I may process a buyer identifier or email address, order reference, purchased product, purchase date and payment or refund status. I use only what is needed for support, refunds, licence or download entitlement verification, accounting and claims. The source of this information is itch.io or you. It is not added to a marketing list.

The legal bases are performing the product contract (Article 6(1)(b) GDPR), compliance with accounting or tax obligations where applicable (Article 6(1)(c) GDPR), and my legitimate interest in preventing fraud and handling claims (Article 6(1)(f) GDPR). Unnecessary notification emails are deleted. If a separate entitlement record is needed, it is retained while that entitlement continues; legally required records follow the applicable statutory period, and records of a specific dispute follow its limitation period. itch.io determines retention for the information it controls.

There is currently no direct checkout or customer account on this website. If that changes, this notice will be updated before the new processing starts, including any purchase-access migration.

Privacy preferences

The site's consent interface stores cmd.cookie-consent in your browser's local storage. It contains the configuration version, service signature, saved timestamp and category choices, and expires after 180 days. This record is not sent to me by the current consent interface. It remembers your choice and does not track you across websites.

This storage is necessary to provide the privacy settings you request. To the extent it involves personal data, the basis is my legitimate interest in respecting those settings (Article 6(1)(f) GDPR). Optional Analytics remains a separate consent-based service.

Optional Google Analytics

The website uses Google Analytics 4, measurement ID G-06ECDM46K9, to understand website usage and improve its content and performance. The integration is blocked until you actively accept the Analytics category. Rejecting Analytics or making no choice leaves it off. Consent is not required to play the demo or follow a purchase link.

When enabled, Analytics may process pseudonymous identifiers, cookie values, visited pages and interaction events, session timing, referrer, approximate location, and browser or device information. Google states that GA4 does not log or store individual IP addresses, and for EU traffic uses an IP address to derive coarse location before discarding it. Nicknames and chat messages are not part of the Analytics data described here.

The legal basis is consent (Article 6(1)(a) GDPR). The Analytics property has a 14-month user and event data retention setting. Google's automatic deletion runs periodically. If its “Reset user data on new activity” setting is enabled, a new visit can restart retention for a user identifier; it does not restart retention for every past event. This setting does not limit standard aggregated reports, which may remain available for longer. Cookie lifetimes are described below.

03 / COOKIES & BROWSER STORAGE

What can be switched on?

  • cmd.cookie-consent: local storage for privacy choices, 180 days.
  • _ga: optional Google Analytics cookie used to distinguish browsers; default expiry up to two years, subject to renewal, your browser and configuration.
  • _ga_06ECDM46K9: optional Google Analytics cookie used to maintain session state; default expiry up to two years, with the same qualifications.

The demo may use browser cache or service-worker storage to load game files efficiently. This stores application resources and is separate from optional audience measurement. You can clear site storage in your browser, which may cause game resources to be downloaded again.

To change or withdraw Analytics consent, return to the homepage and select Cookie settings in its footer. Withdrawal stops future Analytics measurement by this integration and the consent interface attempts to remove the Analytics cookies it controls. Clearing local storage alone removes the saved choice; use Cookie settings to withdraw consent explicitly. Browser controls can also remove stored site data.

Withdrawal does not affect processing carried out lawfully before withdrawal and does not automatically erase data already sent to Google. You can separately request erasure where that right applies. Please contact me if you need help.

04 / WHO MAY RECEIVE DATA?

Providers and other recipients

  • Hetzner Online GmbH provides the VPS infrastructure for the website and demo and may process hosting and connection data on my behalf.
  • Google provides Gmail for email communication and, if you consent, Google Analytics for measurement. For an EEA Analytics agreement, the relevant service entity is Google Ireland Limited, with Google entities involved in processing.
  • itch.io / Itch Corp. operates the external storefront, payment and download platform as a separate controller. Following a normal link opens that service; it does not embed its checkout on this page.
  • Discord operates its own communication platform if you choose that support channel. Its account and platform processing follows its own privacy notice.
  • Other players receive the game information, nicknames and chat messages needed for multiplayer communication.
  • Professional advisers and authorities may receive information where necessary for accounting, legal advice, claims or a legally required disclosure.

I do not sell personal data or use buyer or support contact details for unsolicited marketing. The providers above have different roles; itch.io's own storefront processing is not processing performed solely on my instructions.

Provider information: Hetzner privacy, Google privacy, Analytics data safeguards, itch.io privacy, and Discord privacy.

05 / INTERNATIONAL TRANSFERS

Data outside the EEA

Using Google services can involve processing by Google entities and infrastructure outside the European Economic Area, including in the United States. Google's published transfer information describes reliance on applicable adequacy decisions, including the EU–US Data Privacy Framework for eligible certified recipients, and standard contractual clauses where applicable. See Google's transfer frameworks and the Analytics data-processing terms. You can contact me for information about the safeguards applicable to my processing or to request a copy, subject to necessary protection of confidential information.

If you use itch.io or Discord, those services process data under their own notices and may transfer it internationally. For example, itch.io states that EU users' information may be transferred to the United States. Their notices explain their separate processing and transfer arrangements.

06 / YOUNGER PLAYERS

Children and privacy

Children may use the public demo. Choose a fictional nickname and avoid sharing private information in chat. Chat messages are visible to other players. A parent or guardian can contact me about a child's data or a safety concern using the email address above.

Optional Analytics relies on consent. For a service offered directly to a child in Poland, a child under 16 cannot independently give the GDPR consent needed for this processing; consent must be given or authorised by a parent or guardian, with reasonable verification. A lower threshold may apply under another relevant EEA country's law. If the required parental authorisation is unavailable, Analytics must remain off. This rule concerns consent-based processing; it does not automatically prohibit nicknames or multiplayer chat.

Purchases and support on external platforms are also subject to those platforms' age requirements. In particular, itch.io states that its service is not intended for children under 13. Its age rules do not change the rules for this separately hosted demo.

07 / YOUR DATA, YOUR RIGHTS

Your rights under the GDPR

Depending on the legal basis and circumstances, you may request access and a copy, correction, erasure, restriction of processing and data portability. You may object, for reasons relating to your particular situation, to processing based on legitimate interests. You may withdraw consent at any time where processing relies on consent.

These rights have the conditions and exceptions provided by law. To exercise them, email jelongames@gmail.com. I may ask for proportionate information to verify identity where needed. A reply is normally due within one month; a lawful extension of up to two additional months may apply for complex or numerous requests, with notice and reasons within the first month.

You can complain to the President of the Personal Data Protection Office in Poland (Prezes Urzędu Ochrony Danych Osobowych), uodo.gov.pl, or another competent supervisory authority. Requests concerning information controlled independently by itch.io, Google or Discord may also need to be addressed to that provider.

08 / REQUIRED OR OPTIONAL?

Your choices

Connection and live game data are technically necessary to join and play online. Use a made-up nickname wherever a name is requested. Sending chat messages or contacting me is voluntary, although I may be unable to reply without a working reply address or handle. Proof of purchase may be needed for purchase-specific support. itch.io explains which checkout information its service requires.

Analytics is optional. Refusing or withdrawing it does not prevent playing or buying. I do not use your data for automated decisions, including profiling, that produce legal or similarly significant effects within Article 22 GDPR.

09 / YOUR OWN SERVER

The downloadable starter

The purchased client and server source code do not send telemetry or player data back to me. If you deploy the starter on your own infrastructure, you are responsible for that deployment's data processing and notices. This policy covers my public website and demo, not games hosted independently by purchasers.

10 / PATCH NOTES, BUT LEGAL

Changes to this policy

The date above identifies this version. The notice will be updated when the services, providers or processing change. Material changes will be communicated appropriately where required. Publishing an updated policy does not itself grant Analytics consent.
